Kiowa County Board of Commissioners Meeting Minutes April 23, 2026

The Regular meeting of the Kiowa County Commissioners was called to order on April 23, 2026, at 9:00 a.m. by Chairman Donald Oswald.
Present:
- Donald Oswald, Chairman
- Howard "Butch" Robertson, Commissioner Mike Lening, Commissioner
- Adrienne Yates, County Clerk
- Tina Adamson, County Administrator

Call to Order:
- Chairman Donald Oswald called to order at 9:00 a.m.
- Commissioner Lening opened with prayer and the Pledge of Allegiance
- Commissioner Robertson moved to approve the minutes from April 9, 2026. Lening seconded. Motion carried.
- Commissioner Lening moved to approve the vouchers as presented; Robertson seconded, motion carried.
- Commissioner Oswald moved to approve the agenda with 1 addition; Robertson seconded. Motion carried.
Old Business:
Grant Updates/ COOT Grant: Adamson advised she has received a Notice to Proceed on the transit building. There is no update on the mini-grants, Adamson is waiting on the application. The grant and money is in place for new transit vans but the portal to purchase has not opened yet.
Landfill/ Recycling: Adamson is working on landowner contacts and will be scheduling a survey of the possible expansion land. Jeff Scranton, Landfill Foreman has attended the asbestos class and has his certification test scheduled. The shredder delivery date is still possibly near the end of May.
Housing: Cactus Corner is still moving forward but no occupancy date yet.
Planning & Zoning Update/ Fees / Regulations: Commissioner Robertson has been approached by a resident who is being contacted about another transmission line. Adamson believes it is not an Xcel line but another company looking at other projects.
Adamson provided her testimony regarding HB 26-1326 which would allow companies to appeal the county decision and bypass the county. Adamson presented an idea to have a development agreement that is in conjunction with the 1041 permit.
Road & Bridge/ Wyckoff Pit/ Landlocked landowner Letter/ Barnes Pit: Adamson handed out a letter regarding the Landlocked Landowner for the board to approve and sign. The repair estimate for the loader is $36,000. The application for the Wyckoff Pit was accepted and a decision by July 20th
Robertson was notified the Barnes pit has good gravel but lacks good dirt to mix it with. There was discussion about solutions.
Sales/Use Tax Question: Adamson started a discussion about whether or not to put forth the question on the November ballot. After discussion, the BOCC is tabling the decision until the next meeting.
Appointments:
- Oswald moved to recess regular session for an Executive Session: Executive session for Legal Counsel pursuant to CRS 24-6-402(4)(b) for a conference with the County special counsel for the purpose of receiving legal advice regarding county regulations. The County special counsel certifies they have reviewed the information to be discussed, and it contains attorney-client confidential information; therefore, this session shall not be recorded. Lening seconded. Motion carried at 10:50 a.m.
Oswald moved to exit executive session and resumed regular session at 12:30p.m.
- Terri Jobe, KCLD -Annual Library Update: Jobe entered the meeting at 1:30 p.m. Jobe provided a packet of updates and statistics provided to the state and a report of the last year and her vision for the future. Jobe updated on several grants that have been awarded to the library. Jobe discussed the decline In visitation and how she is trying to increase visitation and Involvement. Jobe exited the meeting at 1:49 p.m.
Oswald moved to recess for lunch at 12:31p.m. The meeting resumed at 1:34 p.m.
New Business:
Monthly reports were handed out to the Board.
Time-Off Requests: None
New Hire Progress Report: No updates on new employee
Railroad Derailment Clean-Up: Board members have been approached about the lack of clean-up with the derailment from 2025. There was discussion about the responsibility; the train line and the over-turned cars and spillage is all within the private railroad right-of-way. The board decided to contact the attorney representing the company and railroad to see what the plan for clean-up is.

With no further business, Lening moved to adjourn at 4:15 pm; Robertson seconded. Motion carried. Next Regular Meeting: Thursday, May 14, 2026, at 9:00 a.m.
