NOTICE OF HEARING ON A PROPOSED SERVICE PLAN FOR THE ORGANIZATION OF

THE KIOWA COUNTY FIRE PROTECTION DISTRICT

NOTICE IS HEREBY GIVEN that the Kiowa County Fire Protection District Stakeholders have petitioned the Board of County Commissioners of Kiowa County for approval of a proposed Service Plan for the organization of the Kiowa County Fire Protection District, which Service Plan was filed with the County on June 20, 2016.  Pursuant to § 32-1-204, C.R.S., a public hearing will be held before the Kiowa County Board of County Commissioners at the date, time and location specified below:

DATE AND TIME OF BOARD OF COUNTY COMMISSIONER’S HEARING: August 1, 2016 at 3:30 p.m.

LOCATION OF HEARING: Meeting Room of the Board of County Commissioners of Kiowa County, Kiowa County Courthouse, 1305 Goff Street, Eads, Colorado.

PURPOSE: The purpose of the hearing is to provide the public with an opportunity to comment upon the requested approval of a proposed Service Plan for the formation of the Kiowa County Fire Protection District, a Title 32 special district to be organized under the laws of the State of Colorado, § 32-1-101, et seq., C.R.S. Any person in support of, or objecting to, the proposed Service Plan may appear at such date, time, and place indicated above to address the County Commissioners, or may send written comments to the Kiowa County Board of County Commissioners prior to the hearing

SERVICE PLAN: A copy of the submitted Service Plan is available for public inspection and copying at the offices of the Board of County Commissioners, 1305 Goff Street, Eads, Colorado.

MILL LEVY: The Service Plan proposes a mill levy of 3.5 mills to be levied on all taxable property within the legal boundaries of the proposed District.  There is no statutory maximum. Voter approval is required for any future tax increases.

GENERAL DESCRIPTION OF THE PROPOSED DISTRICT’S BOUNDARIES/SERVICE AREA: The area is co-terminus with those of the four volunteer fire departments located in the towns of Towner, Sheridan Lake, Eads, and Haswell in Kiowa county.  The District will encompass Kiowa County in its entirety and its boundary lines are identical to the Kiowa County boundary lines.

PROCEDURE FOR EXCLUSION: Any person that owns property within the proposed Service Area may file, no later than July 22, 2016 a written request petitioning for exclusion of that party’s property from the proposed District’s boundaries/Service Area pursuant to § 32-1-203(3.5), C.R.S., such date being 10 days prior to the hearing. The Board of County Commissioners may consider and determine such requests at the hearing.

If a court reporter is desired for either hearing, please advise the Administrator to the Kiowa County Board of Commissioner’s Office (see below), in writing, at least five days prior to the hearing. The cost of engaging a court reporter shall be borne by the requesting party.
